{"id":18814,"date":"2022-08-30T08:18:45","date_gmt":"2022-08-30T08:18:45","guid":{"rendered":"https:\/\/dailykashmirpost.com\/eng\/?p=18814"},"modified":"2022-08-30T08:18:45","modified_gmt":"2022-08-30T08:18:45","slug":"ecp-barred-from-taking-action-against-pti-in-contempt-case","status":"publish","type":"post","link":"https:\/\/dailykashmirpost.com\/eng\/2022\/08\/30\/ecp-barred-from-taking-action-against-pti-in-contempt-case\/","title":{"rendered":"ECP barred from taking action against PTI in contempt case"},"content":{"rendered":"<p>The Sindh and Lahore high courts on Tuesday retrained the Election Commission of Pakistan (ECP) from taking action against the Pakistan Tehreek-e-Insaf (PTI) leaders Asad Umar and Fawad Chaudhry.<\/p>\n<p>Fawad Chaudhry had moved the Lahore High Court (LHC)\u00a0Rawalpindi bench against the electoral watchdog\u2019s contempt of commission notice.<\/p>\n<p>Earlier this month, the ECP had\u00a0<a href=\"https:\/\/tribune.com.pk\/story\/2372044\/imran-other-pti-leaders-issued-contempt-notices-for-insulting-cec\" rel=\"nofollow\">issued<\/a>\u00a0contempt notices to PTI leaders Imran Khan, Fawad Chaudhry and Asad Umar for levelling allegations at the electoral body and Chief Election Commissioner (CEC) Sikander Sultan Raja.<\/p>\n<p>The electoral body had directed the opposition leaders to appear before it in person or submit their response through their lawyers on August 31.<\/p>\n<p>As Justice Jawad Hassan heard the case today (Tuesday), Fawad\u2019s counsel Advocate Faisal Farid argued that the ECP is not a court and therefore as per the constitution is not protected by the \u201ccontempt of court provisions\u201d.<\/p>\n<p>Subsequently, the court issued a notice seeking a response from the electoral body on September 7 while restraining it from issuing a final order on the matter.<\/p>\n<p><strong>ECP contempt case<\/strong><\/p>\n<p>Meanwhile, on Tuesday, the ECP held a hearing on the contempt case against PTI chief Imran Khan, party General Secretary Asad Umar and senior member Fawad Chaudhry.<\/p>\n<p>Imran\u2019s lawyer Ali Bukhari informed the commission during the proceedings that he was \u201cunsure why the notice was served\u201d and requested time to submit a response.<\/p>\n<p>Bukhari said that the order of the commission has also been challenged in the Sindh High Court (SHC) while the LHC\u00a0has restrained the ECP from taking a decision. Later, PTI lawyer Faisal Chaudhry informed the court that the SHC had also stopped the commission in Asad Umar\u2019s case.<\/p>\n<p>The former ruling party&#8217;s lawyer also claimed that they had \u201clearned of the notice only orally\u201d and requested time to submit the power of attorney letters. Upon this, the commission adjourned the hearing until September 7.<\/p>\n<p>While issuing notices earlier, the ECP spokesperson had said in a\u00a0<a href=\"https:\/\/tribune.com.pk\/story\/2372044\/imran-other-pti-leaders-issued-contempt-notices-for-insulting-cec\" rel=\"nofollow\">statement<\/a>\u00a0that notices were issued to the PTI chief Imran Khan for using \u201cinsulting and unparliamentary remarks\u201d against the electoral body in various speeches.<\/p>\n<p>The commission had said it issued notices after reviewing the speeches of the PTI leaders which were provided by the Pakistan Electronic Media Regulatory Authority (Pemra) on the electoral body\u2019s request.<\/p>\n<p>The ECP had sought clarification from the PTI leaders on allegations hurled against it.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Sindh and Lahore high courts on Tuesday retrained the Election Commission of Pakistan (ECP) from taking action against the Pakistan Tehreek-e-Insaf (PTI) leaders Asad Umar and Fawad Chaudhry.
